1. Agreement
These terms are an agreement between you and FAFO Marketing, LLC, based in Iowa ("we", "us"), which operates dadabase.. They cover our website at dadabase.co, our Slack app and our email list (together, the "Services"). By using the Services you agree to these terms and to our Privacy Policy. If you do not agree, please do not use them.
2. Who can use the Services
The website is intended for people 13 and older. The email list and the Slack app are intended for adults (18 and older). If you use the Slack app on behalf of an organization, you confirm you have authority to do so. The Services are intended for people in the United States.
3. The Services
- Website. A searchable archive of jokes, plus related pages.
- Slack app. Posts a joke to a channel on a schedule a workspace administrator sets, answers the /dadjoke command, and offers sharing and rating. It is free. We do not charge for it and we do not show advertising in it.
- Email list. Jokes and occasional announcements, if you subscribe. You can unsubscribe at any time.
We may change, pause or end any part of the Services at any time, and we may add features. Because the Services are free, we do not promise they will always be available or that the Slack app will deliver every scheduled post. A post can be delayed or skipped, for example if Slack is unavailable or the channel can no longer be posted to.
4. Content and humor
The jokes are intended as humor and for entertainment. Jokes are collected from many sources, including jokes that are traditional or widely repeated, and some may be crude, offensive or unsuitable for some audiences. We make an effort to keep the more adult material out of the places most people encounter it, and the Slack app draws from a narrower selection, but we cannot promise that any joke is appropriate for you, your workplace or your audience. You are responsible for deciding whether to read, post or share a joke, and workspace administrators are responsible for how the Slack app is used in their workspace.
Nothing on the Services is professional, legal, medical or financial advice.
5. Ownership and your use of the Services
The dadabase. name, logo, design, software and the way the archive is organized belong to us or our licensors. We grant you a limited, personal, non-exclusive, revocable permission to use the Services for your own non-commercial purposes, and to share links to jokes and short excerpts with attribution.
Jokes in the archive come from many people, and we do not claim to own jokes written by others. If you want to use the archive beyond sharing individual jokes, for example copying large parts of it, republishing it or putting jokes on products, contact us first.
You agree not to:
- use the Services to break the law, or to harass, threaten, defame or discriminate against anyone;
- interfere with or overload the Services, or try to get around their security or rate limits;
- copy the archive in bulk with automated tools, or build a competing product from it, without our written permission;
- use the Slack app to post content you do not have the right to post, or to send unwanted messages to people;
- pretend to be someone else, or misrepresent your connection to dadabase..
6. Copyright and takedown requests
We respect other people's rights. If you believe a joke or other material on the Services infringes your copyright, email [email protected] with: your name and contact details; a description of the work you say was copied; the web address of the page where it appears; a statement that you believe in good faith the use is not authorized by the owner, the owner's agent or the law; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner; and your signature (typed is fine). We will review it promptly and may remove the material while we do. We may remove content and end access for people who repeatedly infringe.
7. Third-party services
The Services rely on and link to services we do not control, including Slack, SendFox, Google reCAPTCHA and Cloudflare. Your use of them is covered by their own terms and policies, and we are not responsible for them. Using the Slack app is also subject to Slack's terms.
8. Slack app: administrators and removal
Only workspace administrators and owners, and the person who installed the app, can schedule posts. They are responsible for choosing channels and times appropriately. Anyone with the right permissions can pause a schedule, delete it or remove the app from the workspace at any time. Removing the app deletes the information we hold about the workspace, as described in the Privacy Policy.
9. Disclaimer of warranties
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted or error-free operation. We do not warrant that jokes will be funny, accurate or appropriate, that the Services will meet your needs, or that messages will always be delivered on time. Some places do not allow these exclusions, so some of them may not apply to you.
10. Limit of liability
To the fullest extent the law allows, we and our owners, officers, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, loss of goodwill or workplace or reputational harm, arising from or related to the Services, even if we were told they were possible. To the fullest extent the law allows, our total liability for all claims relating to the Services will not exceed one hundred U.S. dollars (US$100).
Nothing in these terms limits liability that the law does not allow to be limited, including liability for fraud, for willful injury, or for violating the law. If you live somewhere that does not allow some of these limits, they apply only as far as your local law permits.
11. Your responsibility to us
If your misuse of the Services, or your breach of these terms, causes a third party to bring a claim against us, you agree to cover our reasonable losses from that claim, to the extent the law allows. This does not apply to claims caused by us.
12. Ending your use
You can stop using the Services at any time. We may suspend or end your access, or block a workspace, if you break these terms, misuse the Services or put them at risk, or if we end the Services. Sections that by their nature should continue (including ownership, disclaimers, limits of liability and the sections on law and disputes) will continue after you stop.
13. Governing law and disputes
If you have a complaint, please email us first at [email protected]. Most problems can be sorted out informally, and we will respond promptly.
These terms are governed by the laws of the State of Iowa, without regard to its conflict-of-law rules. If a dispute cannot be settled informally, it will be brought in the state or federal courts located in Iowa, and you and we agree to those courts' jurisdiction. Either of us may also bring an individual claim in small claims court where you live, if it qualifies. This section does not take away any rights you have under consumer protection laws that apply where you live and cannot be waived by contract.
14. Notice for California users
Under California Civil Code section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
15. Changes to these terms
We may update these terms. When we do, we will change the effective date at the top. If a change is significant, we will make a reasonable effort to tell you, such as a notice on the site. If you keep using the Services after a change takes effect, you accept the updated terms. If you do not accept them, stop using the Services.
16. General
- Whole agreement. These terms and the Privacy Policy are the whole agreement between you and us about the Services.
- If part is unenforceable. If a court finds part of these terms unenforceable, the rest stays in effect.
- No waiver. If we do not enforce a right right away, we have not given it up.
- Transfer. You may not transfer your rights under these terms without our written agreement. We may transfer ours as part of a sale or reorganization of the business.
- Notices. We may give you notices by posting them on the Services or by email. You can reach us at [email protected].
